LIABILITY RELEASE & ACCEPTANCE OF RISKS: When buying a firearm and/or gunparts from us, you specifically release us from any liability involved in selling you firearms and/or gun parts in event you fail to have a capable gunsmith adjust, inspect, repair and install gun parts and/or make firearms inspections and repairs as needed, prior to loading or use of any firearm.

We recommend all firearms be inspected by a qualified gunsmith prior to loading, firing or using to ensure the firearm is in safe operating condition. Failure to do so may result in property damage, injury or even death. Always inspect the bore and safeties before loading. Always verify the caliber of all firearms prior to loading.

Many of our firearms come from citizens, other dealers and estate auctions, and often times we do not know the history on these firearms. Take this into consideration when bidding. This is a risk that is related to auction purchases wherein buyers are willing to accept potential risks for benefits of lower auction sales prices.

ALL GUNS & PARTS SOLD AS IS: All part guns, parts, used firearms and new firearms are sold AS-IS. No Refunds, No Returns, No Warranty Whatsoever. For new guns, customers may have an applicable warranty repair from the manufacture, but no warranty whatsoever by DANGELCO Dwight Angel Company, Angels Armory & Forge, Florida Gun Parts or US Weapons Auction.

LICENSE REQUIREMENTS: All firearms sold by us require shipping to a federal firearms licensed dealer only. 

NO TEST FIRING OF FIREARMS: We do not test fire firearms, we do not have a range. If we are aware of any issues with the mechanical operation of a firearm, we will state it in our listing.

LISTINGS PHOTOGRAPHS: The photo used in a listing may be a stock photograph.

AUCTION SALES: We are selling items in an auction, with auction rules of  "AS IS",  at a reduced price for inventory reduction. Most of the items we sell are antique, used & vintage goods, as well as curios and relics and the sales format is an auction consisting of bidding or buy it now, therefore we sale all items "AS IS".

FIREARMS AND/OR GUNPARTS CONDITION: Buyers should understand that used items may have blemishes, dents, dings, bumps, discoloration, scratches, wear, storage or handling wear, and other signs of use.

As the seller of firearms and/or gun parts we do not specify the condition of used items other than the description of “used” or "new". We use either new or used as the totality of our item condition specifications.  We do not evaluate the condition, extent of wear, or  make any guarantees or promises regarding antiques, curios, relics or used items, other than specifications of new or used.

Errors or mistakes in determining the suitability of an item's suitability for use and intended application usage made by the buyer, will not result in credits, cancellations, refunds or cancellations.

We do not make any attempt to define the application suitability of parts that may also be used on other models or model variations of the same brand firearms, or make any determinations of one part fitting other models or variations of the same gun. 

NO SALES CANCELLATIONS OR REFUNDS: The seller does not accept returns, or make refunds or cancellations, for items we sell on Gunbroker, E bay or other venues.  If you are not in agreement to provision, do not bid or buy a firearm or gunpart.

NO WARRANTIES: This is an auction sale and all item are sold “as-is” with no warranties of any kind, express or implied, except that Seller warrants that what is being sold is rightfully owned by Seller, and free of any valid ownership or financial claims from third parties. All sales are final. Buyer has no right to a return, exchange or refund.

WE DO NOT ACCEPT OFFERS: We do no accept offers, as many times an item may have a very small profit margin mark up. Considering the original item acquisition cost, selling fees, selling cost, label cost, shipping and packing materials, boxes and taxes, our profit often times is very small.

LABELING IDENTIFICATION: Due to the wide variety of guns and gunparts we sell, the label identification in a listing is believed to be accurate, but is not an absolute guarantee. Sometimes guns and gunparts may have no identification markings, especially in antique firearms.

The buyer may have a firearm which is the same make, but may have variations in the design of the item of their specific make. Firearms manufacturers often change design and variations like 1st Model, 2nd Model, etc. The buyer must evaluate the item and make a decision if the item is suitable for their usage and intended firearm application use. Buyer errors in application suitability evaluations will not result in a refund or cancellation. 

ALL GUNPARTS ARE NOT DROP IN: Not all parts are "drop-in." Some may require fitting or installation by a qualified gunsmith. Measure carefully, use pictures to evaluate items and confirm your needs before purchasing. 

RELEASE OF LIABILITY

This contract includes a Release of Liability by the buyer or purchaser whom agrees not to take legal action against the seller for possible damages or injuries resulting from a failure to use a capable gunsmith in the inspection, evaluation and installation of gun parts or otherise making repairs. 

The buyer holds the seller harmless in event of buyer's failure to use a Gunsmith for inspection, evaluation and installation of gunparts and/or safety review. The buyer accepts all risk of property damage or loss, including injury, death or other mishap resulting from failure to have a qualified gunsmith evaluate, inspect and install parts and/or firearms.

This liability release is incumbent upon the buyer, the buyer's relatives and inheritance, buyer's benefactors, estate and investors.

We ship items using the US Postal Service only. All of our items are shipped with tracking numbers. We do not ship to any other person, or other address, than the address and buyer name on file with Gunbroker, E Bay or other venues. We do not offer any form of compensation for failure of the buyer to maintain their shipping address on file with E Bay. Any losses in such episodes are at risk to the buyer.

In event an incorrect address on file with a venue results in an item being returned to us (Seller), we will not re-ship the item until the Buyer confirms there accurate shipping address has been corrected at the venue, and the Buyer submits payment for the corrected address shipping charges and a new shipping label has been submitted by the Buyer. Customer losses related to a incorrect shipping addresses will not result in a cancellation, credit, exchange or refund on our part.

If a buyer wants additional insurance that must be communicated to us, immediately after the item sales and additional insurance cost can be paid by personal or business check.

Any loss related to the Buyer not obtaining insurance sufficient to cover the entire item purchase amount in events of loss, theft or damage, will not result in a cancellation, credit, exchange or refund on our part.

The buyer agrees that the seller uses USPS only for shipping. USPS ground shipping of items are covered up to $100.00 against loss. If more insurance is required by you, you must notify us by e mail, immediately after your purchase. We many times we obtain labels and begin shipping on the same day the item was sold. We ship items out, no later than 3 days from date of sale.

When personal or business checks are used in payment of guns and/or parts, checks must clear our band before items will be shipped.

Returned or insufficient funds checks will result in a $35.00 returned check fee and ran through our bank once.

Customers who purchase and submit payment for a firearm, must ensure a copy of their ship to FFL dealer license is e mailed to us at angel.dwight@yahoo.com.

Inability or failure to obtain a ship to FFL will result in firearms being held in secure storage for no more than 30 days from date of sale, with a $5.00 per day secure storage fee applicable for each day in storage, after (5) days from the date of sale of grace period secure storage.

On or after the 31st day in secure storage, without receipt of a ship to FFL dealer license, all rights to title and ownership will be forfeited by the purchaser, with no recourse for recovery of funds paid for the item.

CONTRACT, DISCLAIMER AND RELEASE AGREEMENT

Individuals and or buyers of used merchandise, do hereby release and forever discharge the DANGELCO Dwight Angel Company, Angels Armory & Forge, Florida Gun Parts and US Weapons Auction including their agents, employees, successors and assigns, and their 
respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now have or may hereafter have, arising out of or in any way relating to 
any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the liability. 

It is understood and agreed that this Release is made and received in a full and complete understanding and agreement that the causes of action, claims and demands mentioned herein contains the entire agreement between the Releasor (Customer) and the Releasee (Gun Dealer) ; and that the terms of this Release are a forma contract and not merely a recital. 

This Release shall be binding upon the buyer, customer, purchaser and his/her respective 
heirs, executors, administrators, personal representatives, successors, and assigns.

If you are not in full agreement to these terms of sale, disclaimer and release agreement in totality, do not make a purchase.
